An order under the Meiji Constitution , however , is deemed valid if only it stipulates matters which should be stipulated by an order under the current Constitution as well , whereas if such an order stipulates matters which should be stipulated by law under the current Constitution , it ceased to be effective in principle on December 31 , 1947 ( Act on Effect , etc. of Provisions of Orders Effective as of Time of Enforcement of the Constitution of Japan , Article 1 ) .

これ に 対 し 、 明治 憲法 下 で 命令 事項 と さ れ て い た もの は 、 それ が 日本 国 憲法 下 で も 命令 事項 で あ る 場合 は 引き続 き 命令 と し て の 効力 を 有 する が 、 法律 事項 で あ る 場合 は 原則 と し て 1947 年 12 月 31 日 限り で その 効力 が 打ち切 ら れ た ( 日本 国 憲法 施行 の 際 現 に 効力 を 有 する 命令 の 規定 の 効力 等 に 関 する 法律 1 条 ) 。
