ويشكل التعريف الوارد في المادة 231-1 من القانون الجنائي المغربي اجتهاداً في سبيل التلاؤم مع التعريف الوارد في الاتفاقية وذلك في مجمل العناصر المشكلة لفعل التعذيب سواء العنصر البشري أو العنصر المادي أو العنصر المعنوي.

The definition in article 1-231 of the Moroccan Criminal Code is an attempt at aligning the text with that of the Convention through the inclusion of all the elements, human, material or physical, constituting an act of torture.
