This study will show how legal guilt is modulated by various factors of modernity and its punishment logic, whose elements combine themselves materially, randomly (i.e. the punitive praxis and the randomness of an event), and rationally in accordance with the search for control and security characterizing the punitive policies of modernity.

Se mostrará entonces cómo la culpabilidad jurídica se modula con diversos factores de la modernidad y su lógica para castigar, combinándose tanto de forma aleatoria y material -praxis punitiva y azar del acontecimiento- como racional, según el afán de control y seguridad propios de las políticas punitivas actuales.
