وتشعر اللجنة بالقلق لكون الإجهاض لا يزال غير قانوني في جميع الظروف وفقاً لدساتير العديد من الولايات بالرغم من القاعدة الاتحادية 046 (NOM-046) الصادرة عن وزارة الصحة وقرار محكمة العدل العليا بشأن دستورية إسقاط الصفة الجرمية عن الإجهاض عام 2008 (المواد 2 و3 و6 و26 من العهد).

The Committee is concerned that, despite Federal Norm 046 (NOM-046), issued by the Ministry of Health, and the Supreme Court’s ruling on the constitutionality of the decriminalization of abortion in 2008, abortion is still illegal in all circumstances under the constitutions of many states (arts. 2, 3, 6 and 26 of the Covenant).

Al Comité le preocupa que, pese a la Norma Federal 046 (NOM-046) emitida por el Ministerio de Salud y el dictamen de la Suprema Corte de Justicia sobre la constitucionalidad de la despenalización del aborto en 2008, el aborto sea aún ilegal en todas las circunstancias conforme a las constituciones de muchos estados (arts. 2, 3, 6 y 26).

Le Comité est préoccupé par le fait que, malgré la Norme fédérale 046 (NOM-046) promulguée par le Ministère de la santé et la décision de la Cour suprême sur la constitutionnalité de la dépénalisation de l’avortement en 2008, l’avortement demeure illégal dans tous les cas conformément à la Constitution de nombreux États (art. 2, 3, 6 et 26).

Комитет обеспокоен тем, что, несмотря на Федеральный норматив 046 (NOM-046), введенный Министерством здравоохранения, и заключение Верховного суда от 2008 года по вопросу о конституционности декриминализации абортов, согласно конституциям многих штатов аборты остаются незаконными при любых обстоятельствах (статьи 2, 3, 6 и 26 Пакта).
