Significant developments since the Commission had begun consideration of the topic included the proliferation of bilateral and regional investment agreements incorporating most-favoured-nation clauses over the past two decades; the development of an extensive multilateral trading system under the auspices of the World Trade Organization (WTO), which had broadened the scope of most-favoured-nation treatment to include services, investment and intellectual property; the development of inconsistent jurisprudence as a result of arbitral decisions pertaining to the precise scope of application of the clause; and the emergence of new issues in the context of the current social and economic conditions.

Depuis que la Commission s’est saisie de ce sujet, l’évolution a été marquée par la prolifération, depuis une vingtaine d’années, d’accords bilatéraux et régionaux relatifs aux investissements incluant la clause de la nation la mieux favorisée, le développement d’un vaste système commercial multilatéral sous les auspices de l’Organisation mondiale du commerce (OMC), qui a élargi la portée de ce traitement aux services, aux investissements et à la propriété intellectuelle, la constitution d’une jurisprudence contrastée résultant de décisions arbitrales concernant le champ d’application précis de cette clause, et l’apparition de questions nouvelles dans le contexte des conditions socioéconomiques actuelles.
