C-024/03 It has been determined that the trust indenture to be made in December, 2003 between Fairmont Hotels & Resorts Inc. and the Bank of New York, as trustee, for the issuance of convertible senior notes that will be registered pursuant to a shelf registration statement filed with the United States Securities and Exchange Commission, is exempt pursuant to subsection 82(3) of the Canada Business Corporations Act from the application of Part VIII of the Act.
