وفي الحالات التي يتسبب فيها التعايش معاً في ضرر بدني أو معاناة عقلية أو ضرر جسيم يلحق بسلامة أيٍ من الطرفين فإن الشخص الذي يعاني له أن يطلب من المحكمة أن تأمر بالفصل بينهما إذا ما استمرت هذه الحالة.

In cases where living together may cause physical harm or mental anguish, or seriously damage the happiness of either party, the person that stands to suffer may request the court to order that he or she live separately while the situation continues.

En los casos en que la vida en común pudiera entrañar daño físico o angustia emocional, o tener graves consecuencias sobre el bienestar de una de las partes, la persona que se encuentra en esa situación podrá pedir al tribunal que disponga que viva separada de la otra parte en tanto se mantenga dicha situación.
