غير أن المشتري لم يسدد الفاتورة وادعى أن البائع قد أخلّ بالعقد لأن البلاط ليس من النوعية المطلوبة بموجب العقد (حيث إن الطبقة الصقيلة للبلاط قد تآكلت بالفعل) وأن طرفا ثالثا تكبّد خسائر بعد أن اشترى منه ذلك البلاط.

The buyer did not pay the invoice, claiming that the seller had breached the contract on the ground that the tiles were not of the quality required by the contract (since the glazing of the tiles had already worn off) and that upon sale of these tiles to a third party, this latter had suffered damages.
