فهي إحدى مظاهر مبدأ المساواة في السيادة، ويمكن النظر إليها بوصفها تعبيرا عن الحق الأساسي الذي يتمتع به جميع الدول، دون تمييز، في الاستثناء من نطاق قاعدة ناشئة ما.
