2- إذا تضمنت مشارطة الإيجار نصا على إحالة المنازعات الناشئة بموجبها إلى التحكيم وصدر سند شحن استنادا إلى مشارطة الإيجار دون أن يتضمن ملاحظة خاصة تفيد أن هذا النص ملزم لحامل سند الشحن، لا يجوز للناقل الاحتجاج بهذا النص تجاه حامل السند الحائز له بحسن نية.

An action for damages must be brought, at the option of the plaintiff, in the territory of one of the High Contracting Parties, either before the Court having jurisdiction where the carrier is ordinarily resident, or has his principal place of business, or has an establishment by which the contract has been made or before the Court having jurisdiction at the place of destination.

La acción de responsabilidad deberá suscitarse, a elección del demandante, en el territorio de una de las Altas Partes Contratantes, ya ante el Tribunal del domicilio del porteador, del domicilio principal de su explotación o del lugar donde posea un establecimiento por cuyo conducto haya sido ultimado el contrato, ya ante el Tribunal de lugar de destino.
