فالقلق إزاء الهجرة غير المنظمة والاتجار وسوء استخدام إجراءات اللجوء والصعوبات التي تكتنف معالجة حالات رفض اللجوء أدت بعدد من الدول إلى تعديل تعريف الإطار القانوني الذي يوفر الحماية للاجئين وإيلاء الأولوية إلى مفاهيم مراقبة الهجرة، أو إلى تقليل التركيز على دور الإطار القانوني الدولي المنظم وزيادة الاعتماد على أشكال الحماية القائمة على أساس استنسابي.

Concerns over irregular migration, trafficking, abuse of asylum procedures, and the difficulties in dealing with rejected cases have led a number of States either to redefine the legal framework offering refugee protection and to bring migration control concepts to the fore, or to de-emphasise the role of a structured international legal framework and rely increasingly on discretionary forms of protection.

La inquietud que suscitan la inmigración ilegal, la trata de personas, el abuso de los procedimientos de asilo y las dificultades que suponen los casos rechazados ha llevado a algunos Estados a redefinir el marco jurídico de protección a los refugiados y a dar prioridad a los conceptos de control de la inmigración, o bien a restar importancia al papel de un marco jurídico internacional estructurado y a basarse cada vez más en formas de protección discrecionales.

Les préoccupations concernant la migration irrégulière, le trafic de personnes, l'abus des procédures d'asile et les difficultés pour traiter des cas rejetés ont conduit un certain nombre d'Etats, soit à redéfinir le cadre juridique offrant une protection aux réfugiés et à mettre sur le devant de la scène les concepts de contrôle à l'immigration, soit à réduire le rôle d'un cadre juridique international structuré et à dépendre de plus en plus de formes discrétionnaires de protection.

Обеспокоенность по поводу незаконной миграции, торговли людьми, нарушения процедур предоставления убежища, а также трудности, связанные с рассмотрением случаев отказов, стали причиной того, что некоторые государства были вынуждены либо пересмотреть правовые рамки защиты беженцев и выдвинуть на первый план концепцию контроля за миграцией, либо уменьшить роль устоявшихся международно-правовых механизмов и во все большей степени использовать дискреционные формы защиты.
