والواقع أن التمليك الفردي، مقرونا بقابلية الأراضي للتسويق، قد لا يتوافق والاعتراف بأشكال الحيازة العرفية فيما يتعلق بالأراضي الجماعية وموارد الملكية المشتركة، مما يضع الجماعات التي لا تستغل الأرض بكثافة أو لا تستوطنها بشكل دائم في موقف شديد الضعف.
