Αυτή η προσθήκη στην αιτιολογία της αποφάσεως, η οποία δεν είναι ούτε συντακτικής ούτε γραμματικής φύσεως, θίγει το κύρος του συνόλου των κοινοποιηθεισών πράξεων, καθώς και της αποφάσεως που δημοσιεύθηκε στην Επίσημη Εφημερίδα των Ευρωπαϊκών Κοινοτήτων, όπως έκρινε το Δικαστήριο με την προαναφερθείσα απόφαση της 23ης Φεβρουαρίου 1988, οπότε δεν είναι απαραίτητο να εξεταστεί αν είναι ουσιώδης, πράγμα το οποίο, εξάλλου, δεν αμφισβητείται (70).

"That addition to the statement of reasons for the decision, which relates neither to syntax nor grammar, therefore affects the validity of all the measures notified and of the measure published in the Official Journal of the European Communities, by virtue of the judgment of the Court of Justice in United Kingdom v Council, supra, and it is unnecessary to examine whether the amendment is of a substantial nature - a point which in any event is not in doubt."
