تُلاحظ اللجنة مع التقدير دور المرصد الوطني لحقوق الطفل في تقييم التقدم المُحرز في تنفيذ الاتفاقية [تقرير الدولة الطرف، الفقرة 71] وإنشاء وظيفة أمين المظالم (كانون الأول/ديسمبر 2002) ولكنها تأسف لعدم وجود هيكل مستقل للرصد يتمتـع بولايـة تشمل سلطة تلقي ومعالجة الشكاوى الفردية بشأن انتهاكات حقوق الطفل.

The Committee notes with appreciation the role of the National Observatory on the Rights of the Child in evaluating progress in the implementation of the Convention, as indicated in the State party’s report (para. 71), and the nomination of the Ombudsman, but regrets the absence of an independent monitoring structure with a mandate which would include the power to receive and address individual complaints of violations of the rights of the child.

El Comité observa con aprecio el papel desempeñado por el Observatorio Nacional de los Derechos del Niño en lo que se refiere a la evaluación de los progresos logrados en la aplicación de la Convención, como se indica en el informe del Estado Parte (párr. 71), y el nombramiento de un ombudsman, pero lamenta la falta de una estructura de vigilancia independiente cuyo mandato abarque la facultad de recibir y atender quejas de particulares sobre violaciones de los derechos del niño.

Le Comité prend note en l’appréciant du rôle joué par l’Observatoire national des droits de l’enfant dans le domaine de l’évaluation des progrès réalisés en ce qui concerne la mise en œuvre de la Convention, comme il est indiqué au paragraphe 71 du rapport de l’État partie, ainsi que de la nomination du médiateur, mais il regrette l’absence de structures de suivi indépendantes ayant pour mandat, entre autres, de recevoir et d’examiner les plaintes émanant de particuliers relatives à la violation des droits de l’enfant.

Комитет с удовлетворением отмечает роль Национальной обсерватории по правам ребенка в оценке прогресса в деле осуществления Конвенции, о чем говорится в пункте 71 доклада государства-участника, и назначение омбудсмена, однако выражает сожаление в связи с отсутствием независимой структуры контроля, мандат которой включал бы полномочия по получению и рассмотрению индивидуальных жалоб о нарушении прав ребенка.
