The increased flexibility which the Corbeau judgment brings to bear on the conditions for applying Article 90(2) has been assessed in the following terms: its merit "lies in the fact that it draws attention to the constraints attaching to the provision of public services which recent developments in Community law had perhaps tended to overlook".

De este modo se comprueba el grado de flexibilización que la sentencia Corbeau ha aportado a las condiciones para la aplicación del apartado 2 del artículo 90: esta sentencia "[...] tiene el mérito de atraer la atención sobre las limitaciones que pesan sobre el servicio público, limitaciones a las que la reciente evolución del Derecho comunitario había atribuido quizás una importancia demasiado escasa".
