وبينما طرح سؤال عما إذا كانت هذه النتيجة مستصوبة، رُئي على نطاق واسع أنه إذا استوفت الدعوى المضادة المقتضيات المتصلة بالولاية القضائية بمقتضى المادة 19، لا يوجد سبب يمنع هيئة التحكيم من تناولها توخيا لكفاءة الإجراءات.

While the question was raised whether such a result was advisable, it was widely considered that, if the counter-claim met the jurisdictional requirements under article 19, there was no reason to prevent it from being entertained by the arbitral tribunal in the interest of efficiency.

Si bien se cuestionó que ese resultado fuera aconsejable, predominó la opinión de que si la reconvención interpuesta cumplía con los requisitos jurisdiccionales del tribunal arbitral, con arreglo al artículo 19, no había ningún motivo que impidiera que dicho tribunal entendiera de esa reconvención, si ello obraba en aras de una mayor eficiencia.
