ب) عند تقديم طلب لبدء اجراءات اعسار ضد مدين ما، يكون لأي دائن لهذا المدين، اذا كان طرفا في عقد مالي يشمل المدين، أن [يطبق الضمان] [يمارس ضمانه] ويمارس حقوق المقاصة بموجب ذلك العقد المالي؛
