وواصل المحامون عرضهم قائلين: ”... لقد أكدت الأمم المكتشِفة بنفسها، بفضل ’مبدأ الاكتشاف‘، حق الملكية الكامل والحصري في الأرض، رهناً فقط بمراعاة حق الهنود في شغل الأرض، وأن هذا الحق لا يحتفظ به الهنود إلا بفضل إنعام صاحب السيادة“(51).

The attorneys continued: “... the discovering nations asserted in themselves, by virtue of the principle of discovery, the complete and exclusive title to the land — subject only to a right of occupancy in the Indians, such right being retained by the Indians only by the grace of the sovereign”.51
