If a party not connected with the proceedings suffers damage as a result of the judicial decision (reference is made to the "reflected" authority of res judicata) and claims a legitimate interest, that party may, in continental systems, apply to set the judgment aside, enabling him or her to become a party to the proceedings, and possibly to have the judgment set aside.

Si une partie étrangère au procès subi un préjudice du fait de la décision judiciaire (on parle alors d’autorité « réfléchie » de la chose jugée) et fait valoir un intérêt légitime, dans les systèmes continentaux elle peut faire tierce opposition, ce qui lui permettra de devenir partie au litige et d’obtenir une réformation éventuelle de la décision.
