On two occasions the Supreme Court rejected challenges against the constitutionality of the Act; (2) Yakye Axa indigenous community: the deed for the purchase of alternative land is currently being drawn up together with a right of way on account of the lack of access to the lands in question; (3) Xákmok Kásek indigenous community: the State is still negotiating with the owners of the farms concerned by the claim with a view to concluding the purchase of real estate covering 7,701 hectares; the total area whose return is requested is 12,200 hectares.

La Cour suprême de justice a rejeté par deux fois les actions en inconstitutionnalité engagées contre ce texte; 2) dans l’affaire concernant la communauté autochtone Yakye Axa, l’acquisition d’autres terres et la création d’un droit de passage en raison de l’absence de voie d’accès aux terres concernées sont en cours d’enregistrement; 3) dans l’affaire concernant la communauté autochtone Xákmok Kásek, l’État continue à dialoguer avec les titulaires des propriétés revendiquées afin de réaliser l’achat d’un immeuble implanté sur un terrain de 7 701 hectares, sachant que la surface totale devant être restituée représente 12 200 hectares.

ВС дважды отклонил ходатайства о признании данного закона неконституционным; 2) коренная община якье-акса: в настоящее время подписывается акт о приобретении альтернативных земель и предоставлении сервитуты из-за невозможности получить доступ к указанным землям; 3) коренная община ксамок-касек: государство ведет переговоры с владельцами поместий, на которые были заявлены права, с тем чтобы согласовать условия покупки недвижимости площадью 7 701 га, в случае чего общая площадь подлежащих возвращению земель составит 12 200 га.
