C-023/03r It has been determined that the trust indenture to be made in December 2003 between Imax Corporation, Imax Theatre Holding (Brossard) Inc., Starboard Theatres Ltd., Tantus Films Ltd., others, and US Bank National Association, as trustee, for the issuance of debt obligations thereunder that will be registered pursuant to an exchange offer or other registration statement filed with the United States Securities and Exchange Commission, is exempt pursuant to subsection 82(3) of the Canada Business Corporations Act from the application of Part VIII of the Act.
