وأوضح أنه يود أن يطلب من الأمانة الاهتمام لدى إعدادها للدليل بتوضيح أن عبارة “القانون” في الفقرة (3) ينبغي ألا تُفسر على أنها تعني الأوامر الصادرة بمقتضى القانون عن محكمة أو هيئة قضائية أو هيئة أخرى وبأنها تشير فقط إلى التشريعات القائمة التي تنص على إمكانية إجبار الأطراف على الكشف عن تلك المعلومات.

He wished to request that in the preparation of the Guide, the secretariat should pay some attention to explaining that the words “the law” in paragraph (3) were not to be construed to mean orders made pursuant to the law by a court, a tribunal or some other authority, but referred only to existing legislation which provided for the compellability of such information.
