In making the above recommendation, the Tribunal has taken into account the circumstances enumerated in subsection 30.15(3) of the CITT Act, the most relevant ones being that the contract has yet to be awarded-making contract performance moot-and that MTS has been seriously prejudiced by its virtual inability to bid on the procurement under the terms currently stipulated.

En formulant la recommandation ci-dessus, le Tribunal a tenu compte des facteurs énumérés au paragraphe 30.15(3) de la Loi sur le TCCE, les faits les plus pertinents étant que le contrat n'a pas encore été adjugé - le facteur lié au degré d'exécution du contrat devenant de ce fait non pertinent - et qu'un préjudice sensible a été causé à MTS car il lui était pratiquement impossible, en vertu des modalités prescrites, de soumissionner dans le cadre du marché public.
