286 Ebenso ergibt sich aus Randnummer 86 Absätze 2 und 3 in Verbindung mit Randnummer 87 Absätze 3 und 4 und Randnummer 88 der Entscheidung, daß die Kommission die Einzelakte der Zuwiderhandlung hilfsweise unter den Begriff der "abgestimmten Verhaltensweise" subsumiert hat, wenn sie entweder nicht den Schluß zuließen, daß sich die Partner vorher über einen gemeinsamen Plan für ihr Marktverhalten geeinigt hatten, sondern nur, daß sie Absprachen getroffen oder sich an Absprachen beteiligt hatten, die die Koordinierung ihrer Geschäftspolitik erleichterten, oder wenn sie wegen des komplexen Charakters des Kartells nicht die Feststellung erlaubten, daß einige Hersteller einem von den anderen Herstellern vereinbarten Verhalten uneingeschränkt zugestimmt hatten, sondern nur, daß diese die betreffende Regelung generell unterstützten und sich entsprechend verhielten.

286 Ομοίως, από την ανάγνωση των συνδυασμένων αιτιολογικών σκέψεων 86, δεύτερο και τρίτο εδάφιο, 87, τρίτο εδάφιο, και 88 της Αποφάσεως, η Επιτροπή χαρακτήρισε, επικουρικώς, ως "εναρμονισμένες πρακτικές" τα στοιχεία παραβάσεως, οσάκις αυτά είτε δεν αρκούσαν για να στηρίξουν το συμπέρασμα ότι τα μέρη είχαν συνεννοηθεί προηγουμένως επί κοινού σχεδίου καθορίζοντος τη δράση τους στην αγορά, είχαν όμως δεχτεί ή είχαν προσχωρήσει σε μηχανισμούς συμπαιγνίας που διευκόλυναν τον συντονισμό της εμπορικής τους πολιτικής, είτε δεν αρκούσαν, λόγω του περίπλοκου χαρακτήρα της συμπράξεως, για να αποδειχθεί ότι ορισμένοι παραγωγοί είχαν εκφράσει τη ρητή τους συγκατάθεση στη συμπεριφορά που υιοθέτησαν οι άλλοι, παρ' όλο που εκδήλωναν την υποστήριξή τους στο όλο σχέδιο και δρούσαν αναλόγως.

286 It is likewise apparent from the second and third paragraphs of point 86, the third paragraph of point 87 and point 88 of the Decision, read together, that the Commission in the alternative characterized the elements of the infringement as "concerted practices" where those elements either did not enable the conclusion to be drawn that the parties had reached agreement in advance on a common plan defining their action on the market but had adopted or adhered to collusive devices which facilitated the coordination of their commercial behaviour, or did not, owing to the complexity of the cartel, make it possible to establish that some producers had expressed their definite assent to a particular course of action agreed by the others, although they had indicated their general support for the scheme in question and conducted themselves accordingly.

286 De la même manière, il résulte d' une lecture combinée des points 86, deuxième et troisième alinéas, 87, troisième alinéa, et 88 de la décision que la Commission a qualifié, à titre subsidiaire, de "pratiques concertées" les éléments de l' infraction, lorsque ceux-ci soit ne permettaient pas de conclure que les parties s' étaient entendues au préalable sur un plan commun définissant leur action sur le marché, mais avaient adopté ou s' étaient ralliées à des mécanismes collusoires qui facilitaient la coordination de leurs politiques commerciales; soit ne permettaient pas d' établir, en raison du caractère complexe de l' entente, que certains producteurs avaient exprimé leur consentement formel à une conduite adoptée par les autres, tout en indiquant leur soutien global au plan en question et en agissant en conséquence.

286 Del pari, dalla lettura combinata dei punti 86, secondo e terzo capoverso, 87, terzo capoverso, e 88 della decisione risulta che la Commissione ha qualificato, in subordine, "pratiche concordate" gli elementi dell' infrazione quando questi non consentivano di affermare che le parti avevano previamente raggiunto un accordo su un piano comune che ne definisse l' azione sul mercato, bensì che avevano adottato, o avevano aderito a, pratiche collusive che facilitassero il coordinamento della loro attività commerciale, ovvero quando tali elementi dell' infrazione non consentivano di stabilire, in ragione della complessità dell' intesa, che taluni produttori avevano espressamente approvato gli orientamenti concordati dagli altri, ma solo che essi si erano dichiarati disposti ad appoggiarli e si erano comportati di conseguenza.
