I am also not convinced that the reference to the judgment of the Court of 8 March 1988 in Case 102/86 Apple and Pear Development Council (( 1988 )) ECR 1433, made by the Commission in its written observations in Case 129/88 in support of the criteria which it put forward in Case 231/87, is necessarily relevant to this case .
