ويدعي صاحب البلاغ أن الدولة الطرف انتهكت التزاماتها بموجب الفقرة 1(د) من المادة 2 والمادة 6 من الاتفاقية، بعدم إجرائها تحقيقاً فعالاً من أجل معرفة ما إذا كان يمكن للجمهور الوصول إلى ساحة البناء، وعدد الأشخاص الذين كانوا حاضرين وقت وقوع الحادث، وإلى أي حد كان يمكن لأشخاص آخرين سماع العبارات التي تفوَّه بها صاحب العمل.

The petitioner claims that the State party has violated its obligations under articles 2, paragraph 1 (d), and 6 of the Convention by not investigating effectively to what extent the construction site was accessible to the public, how many people were present at the incident and to what extent it would have been possible for others to overhear the employer’s statements.
