10 Det fremgaar af indlaeggene for Domstolen og af de videnskabelige tidsskrifter, som er vedlagt sagen, og som ikke er blevet bestridt, at ved en saavel terapeutisk som profylaktisk anvendelse i rette doser som angivet paa recepten, ordineres dette produkt bl.a. ved foelgende lidelser: ° hjertelidelser (nedsat hjertekapacitet, tryk og kvaelningsfornemmelser i hjerteomraadet, aeldre personers hjerter, som ikke endnu kraever behandling med digitalin, samt ved andre lette former for hjertesvaekkelse); ° neurovegetative forstyrrelser; ° soevnbesvaer.

10 Wie sich aus der mündlichen Verhandlung vor dem Gerichtshof und den zu den Akten gegebenen wissenschaftlichen Veröffentlichungen, deren Richtigkeit nicht bestritten worden ist, ergibt, bestehen für das Erzeugnis im Rahmen sowohl einer therapeutischen als auch einer prophylaktischen Anwendung bei angemessener, durch ärztliche Verordnung festgelegter Dosierung u. a. folgende Indikationen: ° Kardiovaskuläre Beschwerden (nachlassende Leistungsfähigkeit des Herzens, Druck- und Beklemmungsgefühl in der Herzgegend, noch nicht digitalisbedürftiges Altersherz und leichte Formen der Bradykardie); ° neurovegetative Störungen; ° Schlafstörungen.

10 Συναφώς, διαπιστώνεται καταρχάς, όπως προκύπτει από τη συζήτηση ενώπιον του Δικαστηρίου και από τις επιστημονικές δημοσιεύσεις που επισυνάφθηκαν στη δικογραφία, οι οποίες δεν αντικρούστηκαν, ότι στο πλαίσιο τόσο της θεραπευτικής όσο και της προληπτικής χρήσεως και σε κατάλληλες δόσεις που ορίζονται με ιατρική συνταγή, το προϊόν αυτό χρησιμοποιείται επί των ακολούθων ενδείξεων: * καρδιοαγγειακές διαταραχές (καρδιακή ανεπάρκεια, δυσφορία και πόνος στην περιοχή της καρδιάς, καρδιά ηλικιωμένων που δεν δικαιολογεί ακόμη τη λήψη ντιζιταλίνης και περιπτώσεις ελαφράς μορφής βραδυκαρδίας) * νευρικές διαταραχές * διαταραχές του ύπνου.

10 In that respect it may first be noted, as emerges from the oral argument presented to the Court and also from the scientific publications annexed to the file, which have not been contradicted, that in the course of both therapeutic and prophylactic application and in appropriate dosages determined by medical prescription, this product meets the following indications: ° cardio-vascular disorders (declining cardiac capacity, difficulty in breathing and tightness round the heart, ageing heart not yet justifying treatment with digitalin and mild forms of bradycardia); ° neuro-vegetative imbalances; ° sleeplessness.

10 A este respecto, hay que señalar, en primer lugar, tal como se deduce de los informes pronunciados ante el Tribunal de Justicia y de las publicaciones científicas que se adjuntan como anexo al expediente, que no han sido discutidas, que, en el marco de una aplicación tanto terapéutica como profiláctica y en las dosis adecuadas, fijadas mediante receta médica, dicho producto responde, principalmente, a las siguientes indicaciones: ° trastornos cardiovasculares (disminución de la capacidad cardíaca, sensación de opresión y de ahogo en la región cardíaca, corazón senil que aún no justifica un tratamiento con digital y formas ligeras de bradicardia); ° desequilibrios neurovegetativos; ° trastornos del sueño.

10 A cet égard, il convient d' abord de constater, ainsi qu' il ressort des débats qui ont eu lieu devant la Cour et des publications scientifiques annexées au dossier, qui n' ont pas été contredites, que dans le cadre d' une application tant thérapeutique que prophylactique et selon des doses appropriées, fixées par ordonnance médicale, ce produit répond notamment aux indications suivantes: - troubles cardio-vasculaires (capacité cardiaque défaillante, sentiment d' oppression et d' étouffement dans la région cardiaque, coeur âgé ne justifiant pas encore un traitement à la digitaline et formes légères de bradycardie); - déséquilibres neurovégétatifs; - troubles du sommeil.

10 A questo riguardo, si deve dapprima constatare, come risulta dal dibattimento svoltosi dinanzi alla Corte e dalle pubblicazioni scientifiche allegate agli atti che non sono state contraddette, che, nel contesto di un' applicazione sia terapeutica che profilattica e secondo un dosaggio appropriato, stabilito mediante prescrizione medica, questo prodotto risponde, in particolare, alle seguenti indicazioni: turbe cardiovascolari (capacità cardiaca difettosa, senso di oppressione e di soffocamento nella regione cardiaca, affaticamento cardiaco che non richiede ancora un trattamento a base di digitalina e forme leggere di bradicardia); ° squilibri neurovegetativi, ° turbe del sonno.

10 Zoals bleek ter terechtzitting en uit de bij het dossier gevoegde wetenschappelijke publikaties waarvan de juistheid niet ter discussie is gesteld, kan dit produkt in het kader van een therapeutisch en een profylactisch gebruik bij een aangepaste, bij voorschrift van de arts vastgestelde dosering onder meer worden gebruikt bij hart- en vaataandoeningen (verzwakking van de hartprestatie; gevoel van druk of beklemming in de hartstreek; ouderdomsverschijnselen van het hart die nog niet met digitaline moeten worden behandeld; lichte vormen van bradycardie); stoornissen van het vegetatieve zenuwstelsel; slapeloosheid.

10 Quanto a este aspecto, importa antes de mais constatar, como resulta da discussão perante o Tribunal e das publicações científicas anexas aos autos, que não foram postas em causa, que no âmbito de uma aplicação tanto terapêutica como profiláctica e em doses adequadas, fixadas por prescrição médica, este produto responde designadamente às indicações seguintes: - perturbações cardiovasculares (capacidade cardíaca deficiente, sensação de opressão e sufocação na região cardíaca, envelhecimento do coração não justificando ainda um tratamento com digitalina e formas ligeiras de bradicardia); - desequilíbrios neurovegetativos; - perturbações do sono.
