According to the "Protection and Settlement Support for North Korean Defectors Act," the following circumstances can lead to classification as an 'unprotected defector': â–2 An international criminal who was involved in crimes such as aircraft hijacking, drug trafficking, terrorism, or genocide, â–2 A non-political criminal who has committed serious crimes such as murder, â–2 A suspect of disguised defection, â–2 A person who has resided for more than 10 years in a third country, â–2 A person who is prescribed by Presidential Decree as unfit for recipience of state support, â–2 A person who applies for protection (support) more than one year after entry. '북한이탈주민의 보호 및 정착지원에 관한 법률'에 따르면 ▲항공기 납치, 마약거래, 테러, 집단살해 등 국제형사범죄자 ▲살인 등 중대한 비정치적 범죄자 ▲위장탈북 혐의자 ▲체류국에 10년 이상 생활 근거지를 둔 사람 ▲그 밖에 보호 대상자로 정하는 것이 부적당하고 대통령령으로 정하는 사람 ▲국내 입국 후 1년이 지나서 보호신청한 사람이 '비보호 탈북민'으로 분류될 수 있다. 영화는 간첩이나 안보상의 문제를 가려내기 위해 대한민국에 입국한 탈북민을 '보호'와 '비보호'로 구분하는 상황을 조망함으로써 사회안전망에서 벗어난 비보호 탈북민을 위해 사회통합 차원에서 개선책을 강구할 필요가 있다고 지적한다.
