Jeg skal i den forbindelse i oevrigt bemaerke, at det, saa vidt jeg kan skoenne, saafremt der anfoeres at vaere modstrid mellem den nationale retsforskrift og en faellesskabsregel, maatte tilkomme High Court eller Court of Appeal at rejse dette spoergsmaal af egen drift i overensstemmelse med, hvad der blev fastslaaet i Domstolens dom i Simmenthal-sagen (38).
