مــع اعتــراف اللجنـــة بالمجموعـــة الشاملة من التدابير التشريعية والإدارية والتعليمية التي اعتمدتهـــا الدولـــة الطرف لحمايـــة خـــدم المنازل الأجانب، وباعتمادها القانون الجديد لوكالات التشغيل في نيسان/أبريل 2011، مـــن أجـــل رفع مستوى عمليات التوظيف والحد من التجاوزات والممارسات السيئة، فإنها لا تـــزال تشعر بالقلق إزاء وضع خدم المنازل الأجانب، ولا سيما في ما يتعلق بالفحوصات الدورية الإلزامية لكشف الحمل والأمراض المنقولة جنسياً، ومنع زواجهم من سنغافوريين، وعدم وجود أيام إجازة إلزامية.

While recognizing the comprehensive set of legislative, administrative and educational measures adopted by the State party to protect foreign domestic workers, and the adoption of the new employment agency regulatory framework under the Employment Agencies Act in April 2011 to raise the standard of recruitment processes and minimize abuses and malpractices, the Committee remains concerned at the situation of foreign domestic workers, in particular with regard to the mandatory regular testing for pregnancy and sexually transmitted diseases, the prohibition against marrying Singaporeans and the lack of a mandatory day off.

Aunque aprecia el amplio conjunto de medidas legislativas, administrativas y educativas adoptadas por el Estado parte para proteger a los trabajadores extranjeros del servicio doméstico y la aprobación del nuevo marco reglamentario sobre las agencias de empleo establecido en virtud de la Ley sobre las agencias de empleo en abril de 2011 a fin de elevar el nivel de los trámites de contratación y reducir al mínimo los abusos e irregularidades, el Comité sigue preocupado por la situación de los trabajadores extranjeros del servicio doméstico, particularmente en lo concerniente a las pruebas periódicas obligatorias de embarazo y de enfermedades de transmisión sexual, la prohibición de contraer matrimonio con nacionales de Singapur y la inexistencia de días libres obligatorios.

Sans négliger le vaste arsenal de mesures législatives, administratives et éducatives adopté par l’État partie pour protéger les employées de maison étrangères, et l’adoption en avril 2011 d’un nouveau cadre réglementaire dans le cadre de la loi relative aux agences de placement qui vise à améliorer les règles de recrutement et limiter les mauvais traitements et les abus, le Comité demeure préoccupé par la situation des employées de maison étrangères, notamment en ce qui concerne l’obligation qu’elles ont de passer régulièrement des tests de grossesse et des tests de dépistage des maladies sexuellement transmissibles, l’interdiction qui leur est faite d’épouser un Singapourien et le fait qu’elles n’ont droit à aucun jour de congé.

Признавая важность комплексных законодательных, административных и образовательных мер, принятых государством-участником для защиты иностранной домашней прислуги, а также принятия нового Закона об агентствах по трудоустройству в апреле 2011 года для повышения эффективности процессов найма и сведения к минимуму злоупотреблений и противозаконных действий, Комитет по-прежнему выражает озабоченность в связи с положением иностранных домработниц, которые, в частности, должны регулярно тестироваться на беременность и наличие венерических заболеваний, не могут вступать в брак с гражданами Сингапура и не имеют обязательных выходных дней.

委员会承认,缔约国为保护外籍家庭佣工所采取了一整套立法、行政和教育措施,并为提高招聘程序标准和尽量减少营私舞弊行为而于2011年4月通过了根据《职业介绍所法》制定的新的职业介绍所监管框架,不过,委员会依然对外籍家庭佣工的状况表示关注,尤其是,缔约国强行对外籍家庭佣工定期进行怀孕和性传播疾病检测,禁止外籍家庭佣工与新加坡人结婚,而且不让外籍家庭佣工享受法定休假。
