Στο πλαίσιο της απόφασης της 5ης Φεβρουαρίου 2004 στην υπόθεση C-157/02(1), το έκτο τμήμα του Ευρωπαϊκού Δικαστηρίου αποφάσισε μεταξύ άλλων ότι εισπράχθηκαν υπερβολικά υψηλά τέλη διέλευσης για ολόκληρη τη διαδρομή του αυστριακού αυτοκινητόδρομου του Brenner.

In a judgment in Case C-157/02(1) handed down on 5 February 2004 the Sixth Chamber of the Court of Justice of the European Communities found, inter alia, that excessively high tolls have been charged for the entire length of the Brenner motorway in Austria.
