وحق تقرير المصير هو حق دستوري مارسه شعب جنوب السودان من خلال الاستفتاء لتحديد وضعه المستقبلي وفقاً لاتفاقية السلام الشامل والدستور الانتقالي لسنة 2005، وقانون استفتاء جنوب السودان لسنة 2009 والذي نص على أن يجري الاستفتاء في جنوب السودان وأي مواقع أخرى في التاسع من كانون الثاني/يناير 2011 ونظمته مفوضية استفتاء جنوب السودان بمراقبة دولية ومحلية للاختيار بين وحدة السودان أو الانفصال.

The right of self-determination is a constitutional right that was exercised by the people of Southern Sudan through the referendum to determine their future status in accordance with the Comprehensive Peace Agreement, the Interim Constitution of 2005 and the Southern Sudan Referendum Act of 2009, which provided for the conduct of a referendum in Southern Sudan and elsewhere on 9 January 2011.

El derecho de libre determinación es un derecho constitucional, que el pueblo del Sur del Sudán ejerció mediante un referendum con el que decidió su estatuto futuro de conformidad con el Acuerdo General de Paz y la Constitución Provisional de 2005, así como en virtud de la Ley del referendum del Sudán Meridional de 2009, que disponía que debía celebrarse un referendum en el Sudán Meridional y en cualesquiera otros emplazamientos el 9 de enero de 2011.
