وعندما حدث الهروب الجماعي من سجن إسكوينتلا ذي الاستحكامات الأمنية الشديدة في حزيران/ يونيه 2001 (انظر الفقرة 52)، اتخذت الحكومة قرارا بإعلان “حالة استنفار” لمدة شهر حسب المتوخى في دستور غواتيمالا “في حالة غزو الإقليم أو الاضطراب الخطير للسلم أو الأنشطة المناهضة لأمن الدولة أو حدوث كارثة عامة” مما يدل على عدم وجود حرص حقيقي فيما يتعلق بحماية وضمان أولويات حقوق الإنسان لجميع المواطنين.

Following the mass escape from Escuintla maximum security prison in June 2001 (see para. 52), the Government’s decision to declare a one-month “state of alert”, for which provision is made in the Constitution of Guatemala “in the event of invasion of the national territory, serious disturbance of the peace, activities against the security of the State or public disaster”, was evidence of its failure to adhere strictly to the priority of protecting and safeguarding the rights of the population as a whole.

Al producirse la fuga masiva del penal de alta seguridad de Escuintla en el mes de junio de 2001 (véase párr. 52), la decisión gubernamental de declarar por un período de un mes el “estado de alarma”, previsto en la Constitución de Guatemala “en caso de invasión del territorio, de perturbación grave de la paz, de actividades contra la seguridad del Estado o calamidad pública”, evidenció la falta de un estricto apego a la protección y garantía prioritaria de los derechos del conjunto de la ciudadanía.

La décision qu’a prise le Gouvernement, lorsqu’un grand nombre de condamnés se sont évadés de la prison de haute sécurité d’Escuintla en juin 2001 (voir le paragraphe 52), de proclamer pendant un mois l’état d’urgence prévu par la Constitution guatémaltèque « en cas d’invasion du territoire national, de graves perturbations de la paix, d’activités dirigées contre la sécurité de l’État ou de calamité publique » a montré que l’État ne s’acquittait pas rigoureusement de son obligation de protéger et de garantir les droits des citoyens dans leur ensemble.

После массового побега из тюрьмы строгого режима Эскуинтлы в июне 2001 года (см. пункт 52) принятое правительством решение об объявлении месячного «чрезвычайного» периода, предусмотренного в Конституции Гватемалы «в случае нападения на территорию, грубого нарушения мира, деятельности, направленной на подрыв безопасности государства или общественного спокойствия», свидетельствует об отсутствии строгой приверженности делу защиты и приоритетной гарантии осуществления прав всех граждан.
