وقيل أيضا إن الفقرة (3) من المادة 40 من صيغة القواعد لعام 1976 تنص على أنه عندما تصدر هيئة التحكيم أمرا بإنهاء إجراءات التحكيم أو قرار تحكيم بشروط متفق عليها، يجب أن تحدد مصروفات التحكيم في نص ذلك الأمر أو القرار.

It was further said that article 40, paragraph (3) of the 1976 version of the Rules provided that the arbitral tribunal should fix the costs of arbitration in the text of a termination order or an award on agreed terms when it issued such decisions.
