12 Der Gerichtshof hat den Organen der Gemeinschaft in der Tat bei der Organisation ihrer Dienststellen entsprechend den ihnen übertragenen Aufgaben und bei der Verwendung des ihnen zur Verfügung stehenden Personals für diese Aufgaben ein weites Ermessen eingeräumt, vorausgesetzt jedoch, daß diese Verwendung im dienstlichen Interesse und unter Beachtung der Gleichwertigkeit der Dienstposten erfolgt .

12 Πρέπει να παρατηρηθεί ότι το Δικαστήριο αναγνώρισε πράγματι στα κοινοτικά όργανα ευρεία εξουσία εκτιμήσεως κατά την οργάνωση των υπηρεσιών τους σε συνάρτηση με τις αποστολές που τους ανατίθενται και κατά την τοποθέτηση, ενόψει αυτών των αποστολών, του προσωπικού που τελεί στη διάθεσή τους, υπό τον όρο ωστόσο αυτή η τοποθέτηση να γίνεται προς το συμφέρον της υπηρεσίας και τηρώντας την μεταξύ των θέσεων ισοτιμία.

12 The Court has indeed held that the Community institutions have a broad discretion to organize their departments to suit the tasks entrusted to them and to assign the staff available to them in the light of such tasks, on condition however that the staff are assigned in the interests of the service and in conformity with the principle of assignment to an equivalent post .

Debe observarse que el Tribunal, en efecto, ha reconocido a las instituciones de la Comunidad una amplia facultad de apreciación en la organización de sus servicios, en función de las misiones que les son confiadas, y en el destino, en base a éstas, del personal que se encuentra a su disposición, con la condición, empero, de que dicho destino tenga lugar en interés del servicio y respetando la equivalencia de los puestos de trabajo.

Com efeito, há que referir que o Tribunal tem reconhecido às instituições da Comunidade, em função das missões que lhe são confiadas, um amplo poder de apreciação na organização dos seus serviços e na colocação do pessoal que se encontra à sua disposição, na condição, no entanto, de essa colocação ser feita no interesse do serviço e respeitando a equivalência dos lugares.
