(২) যদি এই মর্মে প্রমাণিত হয় যে, নিবন্ধিত স্বত্বাধিকারী বা অনুরূপ স্বত্বাধিকারীর পূর্বসূরী মার্কটি এইরূপে ব্যবহার করেছেন যে, উক্ত মার্ক নিবন্ধনের তারিখে স্বতন্ত্র বৈশিষ্ট্য অর্জন করিয়াছিল, তা হলে উপ-ধারা (১) এ উল্লিখিত কোন আইনগত কার্যধারায় নিবন্ধিত কোন ট্রেডমার্ক কেবল এই কারণে অবৈধ বলে ঘোষণা করা যাবে না যে, তা ধারা ৬ এর অধীন স্বাতন্ত্র্যসূচক প্রমাণ ব্যতিরেকে, নিবন্ধনযোগ্য ছিল না এবং অনুরূপ কোন প্রমাণ নিবন্ধকের নিকট দাখিল করা হয় নাই।

In all legal procedings as aforesaid a trademark registered in the Register shall not be held to be invalid on the ground that it was not a trademark to be registered under section 6 except upon evidence of distinctiveness and that such evidenec was not submitted to the Registrar before registration, if it is proved that the trademark had been so used by the registered proprietor or his predecessor-in-title as to have become distinctive at the date of registration.
