Article 5 provides that a person becomes entitled to the Citizenship of India if , at the commencement of the Constitution , he has his domicile in the territory of India , he or either of his parents were born in India , or he has been ordinarily resident in the territory of India for not less than five years immediately before the commencement of the Constitution .

अनुच्छेद 5 में प्रावधान किया गया है कि यदि कोई व्यक्ति , संविधान के प्रारंभ 1 पुनर्वास अनुज्ञा ( षेसेट्ट्लेमेन्ट् फेर्मिट् ) पर भारत के राज्य क्षेत्र में अधिवास करता है , उसका या उसके माता - पिता में से किसी एक का भारत में जन्म हुआ था वह या संविधान के प्रारंभ से ठीक पहले कम से कम पांच वर्ष तक भारत के राज्य क्षेत्र में सामान्यतया निवासी रहा है , तो वह भारत की नागरिकता का हकदार बन जाता है .
