Subsidiary protection may be granted to an alien who does not quality for refugee status and is unable to return to his country of origin owing to the fear of torture, cruel or inhuman or degrading treatment or punishment; or if there is a threat that his human rights and fundamental freedoms will be violated; or if his life, health, safety or freedom is under threat as a result of endemic violence which has spread in an armed conflict or which has placed him at serious risk of systematic violation of his human rights.

La protección subsidiaria puede concederse a aquellos extranjeros que no reúnan las condiciones para obtener el estatuto de refugiado y no puedan regresar a su país de origen por miedo a padecer tortura o un trato o castigo cruel, inhumano o degradante; cuando exista el riesgo de que sus derechos humanos y libertades fundamentales sean vulnerados; o cuando su vida, salud, seguridad o libertad se vean amenazadas o exista un grave riesgo de que se produzca la sistemática violación de sus derechos humanos a causa de la propagación de la violencia endémica asociada a un conflicto armado.

La protection subsidiaire peut être accordée à un étranger qui ne répond pas aux conditions d’octroi du statut de réfugié mais ne peut retourner dans son pays d’origine par crainte de torture, de peines ou traitement cruels, inhumains ou dégradants, ou s’il y a un risque d’atteinte à ses droits et libertés fondamentaux, ou si sa vie, sa santé, sa sécurité ou sa liberté sont menacées en raison d’une violence généralisée résultant d’une situation de conflit armé ou l’exposant à une menace sérieuse de violation systématique de ses droits fondamentaux.

Вспомогательная защита может предоставляться тому или иному негражданину, который не имеет достаточных оснований для получения статуса беженца и не может вернуться в свою страну из-за опасений быть подвергнутым пыткам, жестокому или бесчеловечному обращению или унижающему достоинство виду обращения или наказания; либо если существует угроза нарушения его прав человека и основных свобод; либо если существует угроза его жизни, здоровью, безопасности или свободе вследствие вспышки насилия, распространившегося в условиях вооружённого конфликта или создавшего для него серьёзный риск подвергнуться систематическим нарушениям его прав человека.
