The United States authorities were attempting, by means of a discriminatory agency process, to reinterpret the Treaty of Peace and Friendship with the Western Shoshone signed and ratified in 1863 and to deny not only Western Shoshone title and rights to land but also any recourse to formal protest or litigation, offering instead only a meagre monetary recompense that was unacceptable.
