15 Foelgelig skal de forelagte spoergsmaal besvares med, at traktatens artikel 30 skal fortolkes saaledes, at den ikke finder anvendelse paa nationale bestemmelser om butikstid, som gaelder for alle erhvervsdrivende i indlandet, og som, saavel retligt som faktisk, paavirker afsaetningen af indenlandsk fremstillede varer og varer fra andre medlemsstater paa samme maade.

15 Demgemäß ist dem Gerechtshof zu antworten, daß Artikel 30 EWG-Vertrag keine Anwendung auf eine nationale Ladenschlußregelung findet, die für alle im Inland tätigen Wirtschaftsteilnehmer gilt und den Absatz der inländischen Erzeugnisse und der Erzeugnisse aus anderen Mitgliedstaaten rechtlich wie tatsächlich in der gleichen Weise berührt.

15 Κατά συνέπεια, στο εθνικό δικαστήριο πρέπει να δοθεί η απάντηση ότι το άρθρο 30 της Συνθήκης έχει την έννοια ότι δεν έχει εφαρμογή επί εθνικής ρυθμίσεως περί των ωρών κατά τις οποίες τα καταστήματα παραμένουν κλειστά που ισχύει για όλους τους επιχειρηματίες που ασκούν δραστηριότητες επί του εθνικού εδάφους και αφορά κατά τον ίδιο τρόπο, τόσο νομικώς όσο και πραγματικώς, την εμπορία των εγχωρίων προϊόντων και την εμπορία των προϊόντων που προέρχονται από άλλα κράτη μέλη.

15 Consequently, the reply to be given to the Gerechtshof is that Article 30 of the Treaty is to be interpreted as not applying to national rules concerning the closing of shops which apply to all traders operating within the national territory and which affect in the same manner, in law and in fact, the marketing of domestic products and of products from other Member States.

15 Derhalve dient het Gerechtshof te worden geantwoord, dat artikel 30 van het Verdrag aldus moet worden uitgelegd, dat het niet van toepassing is op een nationale wettelijke regeling inzake winkelsluiting die geldt voor alle marktdeelnemers die op het nationale grondgebied activiteiten ontplooien, en die zowel rechtens als feitelijk dezelfde invloed heeft op de verhandeling van nationale produkten en op die van produkten uit andere Lid-Staten.
