(5) Ist die erste Anmeldung in einem Staat eingereicht worden, der nicht zu den Vertragsstaaten der Pariser Verbandsübereinkunft oder des Übereinkommens zur Errichtung der Welthandelsorganisation gehört, so finden die Vorschriften der Absätze 1 bis 4 nur insoweit Anwendung, als dieser Staat gemäß einer veröffentlichten Feststellung aufgrund einer ersten Anmeldung beim Amt ein Prioritätsrecht gewährt, und zwar unter Voraussetzungen und mit Wirkungen, die denen dieser Verordnung vergleichbar sind.

5. If the first filing has been made in a State which is not a party to the Paris Convention or to the Agreement establishing the World Trade Organisation, paragraphs 1 to 4 shall apply only in so far as that State, according to published findings, grants, on the basis of the first filing made at the Office and subject to conditions equivalent to those laid down in this Regulation, a right of priority having equivalent effect.

(5) Ha az első bejelentést olyan államban tették, amely nem részese a Párizsi Egyezménynek vagy a Kereskedelmi Világszervezetet létrehozó egyezménynek, az (1)–(4) bekezdés csak annyiban alkalmazható, amennyiben az érintett állam a közzétett közlemények szerint azonos hatályú elsőbbséget biztosít a hivatalnál tett első bejelentésre alapítva, az e rendeletben megállapított azonos feltételekkel.

(5) Dacă prima depunere s-a efectuat pe teritoriul unui stat care este parte la Convenția de la Paris sau la Acordul de instituire a Organizației Mondiale a Comerțului, dispozițiile de la alineatele (1)-(4) nu se aplică decât în măsura în care acest stat, conform unor constatări publicate, acordă, pe baza unei prime depuneri făcute la Oficiu, un drept de prioritate supus unor dispoziții și având efecte echivalente cu cele prevăzute în prezentul regulament.
