في صفحات هذا التقرير، ولا سيما في التعليقات على المادة 4 من الاتفاقية، بينت السلطات الإسبانية الجرائم بموجب القانون الإسباني التي تشمل الأفعال المعرفة في الاتفاقية بمثابة حالات اختفاء قسري، مشددة على أن الجرائم المعنية هي تلك التي تُعرف بمثابة احتجاز غير قانوني/اختطاف مع الاختفاء كما هي مقرة في القسم السادس من الكتاب الثاني من القانون الجنائي تحت عنوان "الجرائم ضد الحرية".

Throughout this report — particularly the comments on article 4 of the Convention — the Spanish authorities have described the criminal offences under Spanish law which incorporate the acts defined in the Convention as enforced disappearances, emphasizing that the offences concerned are those known as unlawful detention/abduction with disappearance recognized in book II, section VI of the Criminal Code under the heading “offences against liberty.”

A lo largo del presente informe, y en especial en el comentario del artículo 4 de la Convención, se han descrito los tipos penales en que se incardinan los hechos descritos en la Convención como “desapariciones forzadas” y se ha subrayado que dichos tipos son los de detención ilegal/secuestro con desaparición que se recogen en el Título VI del Libro II del Código Penal bajo la rúbrica de “delitos contra la libertad.”

На протяжении настоящего доклада, в частности в комментарии в отношении выполнения статьи 4 Конвенции, говорилось о видах преступлений, которые составляют деяния, квалифицируемые в Конвенции как "насильственные исчезновения", и подчеркивалось, что таковыми являются преступления незаконного задержания/похищения, сопряженного с исчезновением, включенного в раздел VI книги II Уголовного кодекса под названием "Преступления против свободы личности".
