Würde die EdW vor der Verabschiedung eines Insolvenzplans mit der Entschädigung beginnen, so gingen die Ansprüche der Anleger in Höhe des Entschädigungsbetrages auf die EdW über (§ 5 Abs. 5 EAG) und es käme zu einer laufenden Veränderung der Rechtsstellung der sonstigen Gläubiger im Insolvenzverfahren.

If EdW were to start making compensation payments before the adoption of the insolvency plan, creditors’ claims would devolve onto EdW in the amount of the compensation payments (§ 5 (5) of the EAG (Deposit Guarantee and Investor Compensation Act)) and this would result in a constant change in the legal position of the other creditors in the insolvency proceedings.
