As to the former, it was true that that Agreement met a key Nauruan demand for control over the phosphate industry as from independence, but the record of negotiations showed that the question of waiving the rehabilitation claim had been raised and not accepted, and the Agreement itself was silent on the point.

Por lo que respecta al primer motivo, era cierto que en el Acuerdo se satisfacía una demanda fundamental de Nauru relativa al control de la industria de los fosfatos a partir de la independencia, pero, según las actas de las negociaciones, se había tratado la cuestión de la renuncia a la reclamación de rehabilitación pero Nauru no se había avenido a renunciar, y en el propio Acuerdo se guardaba silencio al respecto.

En ce qui concerne l’accord, il est vrai qu’il répondait à une exigence centrale de Nauru relative au contrôle de l’industrie des phosphates à compter de l’indépendance. Что касается первого, то совершенно справедливо, что это соглашение обеспечивало ключевое требование Науру о передаче ей контроля над фосфатной промышленностью с момента получения независимости, однако материалы переговоров свидетельствовали о том, что вопрос отказа от требования в отношении рекультивации земель поднимался и не был принят и что в самом соглашении ничего не говорится по этому поводу.
