5 Die Richtlinie, die die Rechtsvorschriften der Mitgliedstaaten über die Handelsvertreter koordinieren soll, findet ihre Rechtfertigung darin, dass "[d]ie Unterschiede zwischen den einzelstaatlichen Rechtsvorschriften auf dem Gebiet der Handelsvertretungen ... die Wettbewerbsbedingungen und die Berufsausübung innerhalb der Gemeinschaft spürbar [beeinflussen] und ... den Umfang des Schutzes der Handelsvertreter in ihren Beziehungen zu ihren Unternehmen sowie die Sicherheit im Handelsverkehr [beeinträchtigen]"(2).

5. The Directive, whose purpose is the coordination of the laws of the Member States relating to commercial agents, is justified by the fact that the differences in national laws concerning commercial representation substantially affect the conditions of competition and the carrying-on of that activity within the Community and are detrimental both to the protection available to commercial agents vis-à-vis their principals and to the security of commercial transactions.

5 La directive, qui vise à la coordination des droits des États membres relatifs aux agents commerciaux, trouve sa justification dans le fait que «... les différences entre les législations nationales en matière de représentation commerciale affectent sensiblement, à l'intérieur de la Communauté, les conditions de concurrence et l'exercice de la profession et portent atteinte au niveau de protection des agents commerciaux dans leurs relations avec leurs commettants, ainsi qu'à la sécurité des opérations commerciales...»

5 Direktivet, som syftar till att samordna medlemsstaternas lagstiftningar gällande handelsagenter, motiveras av att "... $s$killnaderna inom gemenskapen mellan de nationella lagarna om handelsrepresentation påverkar i hög grad konkurrensvillkoren för och utövandet av denna näringsverksamhet samt försämrar både det befintliga skyddet för handelsagenter gentemot deras huvudmän och skyddet för affärsuppgörelser".( 2)
