أشارت لجنة الدولة المعنية بالإفراج عن الكوبيين الخمسة المحتجزين في الولايات المتحدة إلى أنه في حين لا ينص الدستور الكوبي، في أي من بنوده، على تطبيق عقوبة الإعدام أو إلغائها، ينص قانون العقوبات على هذه العقوبة عن الجنايات الأشد خطورة.

The State Committee for the Liberation of the Five Cuban Prisoners in the United States (CEL5) indicated that the Constitution of Cuba does not include any provision relating to the application or abolition of capital punishment, but the Criminal Code provides for the death penalty for the most serious offences.
