15 De forelagte spoergsmaal maa derfor besvares med, at traktatens artikel 30 skal fortolkes saaledes, at den ikke finder anvendelse paa nationale bestemmelser om butikstid, som omfatter alle erhvervsdrivende, der udoever virksomhed i indlandet, og som, saavel retligt som faktisk, paavirker afsaetningen af indenlandsk fremstillede varer og varer fra andre medlemsstater paa samme maade.

15 Dem vorlegenden Gericht ist daher zu antworten, daß Artikel 30 EWG-Vertrag keine Anwendung auf eine nationale Ladenschlußregelung findet, die für alle im Inland tätigen Wirtschaftsteilnehmer gilt und den Absatz der inländischen Erzeugnisse und der Erzeugnisse aus anderen Mitgliedstaaten rechtlich wie tatsächlich in der gleichen Weise berührt.

15 Κατά συνέπεια, στο εθνικό δικαστήριο πρέπει να δοθεί η απάντηση ότι το άρθρο 30 της Συνθήκης έχει την έννοια ότι δεν έχει εφαρμογή επί εθνικής ρυθμίσεως περί απαγορεύσεως λειτουργίας των καταστημάτων που ισχύει για όλους τους επιχειρηματίες που ασκούν δραστηριότητες επί του εθνικού εδάφους και αφορά κατά τον ίδιο τρόπο, τόσο νομικώς όσο και πραγματικώς, την εμπορία των εγχωρίων προϊόντων και την εμπορία των προϊόντων που προέρχονται από άλλα κράτη μέλη.

15 Accordingly, the answer to the national court must be that Article 30 of the Treaty is to be interpreted as not applying to national legislation on the closure of shops which applies to all traders operating within the national territory and which affects in the same manner, in law and in fact, the marketing of domestic products and of those from other Member States.

15 Por conseguinte, convém responder ao órgão jurisdicional nacional que o artigo 30. do Tratado deve ser interpretado no sentido de que não se aplica a uma regulamentação nacional em matéria de horário de abertura do comércio que é oponível a todos os operadores económicos que exercem actividades no território nacional e que afecta do mesmo modo, de direito e de facto, a comercialização dos produtos nacionais e a dos produtos em proveniência de outros Estados-membros.
