19 С Решение от 9 юли 2009 г. Първоинстанционният съд отхвърля като недопустим писмения отговор на The Queen Sirikit Institute of Sericulture, Office of the Permanent Secretary, Ministry of Agriculture and Cooperatives, Thailand, на основание че той става встъпила по делото страна едва с определението на Първоинстанционния съд от 19 юни 2009 г., поради което към датата на представяне на посочения отговор, а именно 16 декември 2008 г., той бил трета страна по спора.

19 Rozhodnutím ze dne 9. července 2009 rozhodl Tribunál vyjádření k žalobě The Queen Sirikit Institute of Sericulture, Office of the Permanent Secretary, Ministry of Agriculture and Cooperatives, Thailand, odmítnout jako nepřípustné z důvodu, že se vedlejším účastníkem řízení stal až na základě usnesení Tribunálu ze dne 19. června 2009, takže k datu podání uvedeného vyjádření, tedy 16. prosinci 2008, nebyl účastníkem řízení.

19 By decision of 9 July 2009, the Court decided to reject the response of The Queen Sirikit Institute of Sericulture, Office of the Permanent Secretary, Ministry of Agriculture and Cooperatives, Thailand, as inadmissible, on the ground that it was only from the date of the order of the Court, 19 June 2009, that it became an intervener in the dispute, so that, on the date when the response was lodged, that is, 16 December 2008, it was not a party to the dispute.
