أما إذا تعذر على اللجنة الفرعية الاتفاق على المعاملة الملائمة لذلك الدخل، فمن الجائز أن تقدم اللجنةُ إلى لجنة الخبراء مذكرةً تورد مجموعة مختارة من النُهج الممكن اتباعها، أي مذكرة تستبعد بعض الخيارات الممكنة بوصفها لا تصلح، حسب رأي اللجنة الفرعية، للإدراج في التنقيح المقبل لاتفاقية الأمم المتحدة النموذجية.

If the Subcommittee cannot agree on the appropriate treatment, it may be possible for the Subcommittee to provide the Committee with a note in which the range of possible approaches is narrowed, that is to say, a note in which some of the possible options are rejected as being, in the Subcommittee’s view, inappropriate for inclusion in the next update of the United Nations Model Convention.

Si el Subcomité no se pusiera de acuerdo sobre dicho régimen, podría proporcionar al Comité una nota en la que se redujeran las posibles alternativas, es decir, una nota en la que se rechazaran algunas de las posibles opciones en razón de que el Comité las considerara inapropiadas para su inclusión en la próxima versión de la Convención modelo de las Naciones Unidas.

Если же Комитет не придет к согласию относительно надлежащего режима, он сможет представить Комитету записку с меньшим набором возможных подходов, т.е. записку, в которой Подкомитет разъяснит, почему он отвергает те или иные возможные варианты и считает их неприемлемыми для включения в очередной обновленный вариант Типовой конвенции Организации Объединенных Наций.
