34 SKF har gjort gaeldende, at tiltraedelsesaktens artikel 47 og 209, da der ikke findes udtrykkelige bestemmelser til hinder herfor, finder anvendelse paa indfoersler af farmaceutiske produkter, der er beskyttet ved et patent, for hvilket der er meddelt en beredskabslicens, og at de foelgelig uanset traktatens artikel 30 og 36 kan vaere hjemmel for at naegte licenshaveren tilladelse til at indfoere de omhandlede produkter fra Spanien og Portugal.

34 Nach Auffassung der Klägerin sind die Artikel 47 und 209 der Beitrittsakte in Ermangelung ausdrücklicher entgegenstehender Vorschriften auf die Einfuhren pharmazeutischer Erzeugnisse anwendbar, die von einem Patent mit dem Vermerk "Lizenzbereitschaft" erfasst sind, und rechtfertigen es damit, dem Lizenznehmer abweichend von Artikel 30 und 36 EWG-Vertrag die Einfuhr der fraglichen Erzeugnisse aus Spanien und Portugal zu untersagen.

34 Η SKF υποστηρίζει ότι τα άρθρα 47 και 209 της Πράξεως Προσχωρήσεως εφαρμόζονται, ελλείψει ρητών αντιθέτων διατάξεων, στις εισαγωγές φαρμακευτικών προϊόντων που καλύπτονται από δίπλωμα ευρεσιτεχνίας που φέρει την ένδειξη "υποχρέωση παραχωρήσεως αδείας εκμεταλλεύσεως" και μπορούν, ως εκ τούτου, να δικαιολογήσουν, κατά παρέκκλιση από τα άρθρα 30 και 36 της Συνθήκης, την απαγόρευση στον κάτοχο αδείας εκμεταλλεύσεως τέτοιου διπλώματος να εισάγει τα σχετικά προϊόντα από την Ισπανία και την Πορτογαλία.

34 SKF argues that, in the absence of express provisions to the contrary, Articles 47 and 209 of the Act of Accession are applicable to imports of patented pharmaceutical products in respect of which a licence of right has been granted and hence may justify, by way of derogation from Articles 30 and 36 of the Treaty, the refusal to authorize the licensee to import the products in question from Spain and Portugal.
